Wage Garnishment help

An IRS wage levy or a wage garnishment is much different than a bank account levy. Wage levies are filed with your employer and remain in effect until the IRS notifies your employer that the wage levy has been released. When the IRS sends out a notice of wage garnishment to your employer it includes a chart that your employer will use to determine how much to garnish from each of your paychecks.  The tax code allows the IRS to take some-but not all-of your wages or other income. If your income is low or you have several mouths to feed, all of your earnings may potentially be exempt from the wage garnishment. In most parts of the country you would be hard pressed to meet necessary living expenses on the small amount the law allows you to keep from the levy. 

The amount exempt from wage garnishments is dependent on how many exemptions and how frequently you are paid.  The amount you are able to legally keep is determined by the tax code, basically the number of dependents (and your spouse) can claim on your tax return, plus your standard deduction.  These exempt amounts from the wage garnishment is subject o annual revisions for cost of living changes.
